This is a really, really shitty situation.

And unfortunately, it's not just there's so many people that are in this mess.

And it is a it is a mess.

It's all very legal and sensitive.

So I will be reading a script.

But that does not mean that it is not very authentic and very genuine.

It is so unfortunate that I have been forced to put out this video today.

Yesterday, I filed a lawsuit in Texas against Gamers First, Kenny Vaccaro, and Triple Rec for their failure to pay me back for a loan.

In the year of the E.V.O.L.V.E., I loaned E.V.O.L.V.E.

PCs one hundred thousand dollars so they could continue to operate while waiting for an investment.

The founder of E.V.O.L.V.E.

was a fellow Destiny creator named TripleRek, and after a heart to heart I had with him on a phone call, the loan felt like a practically risk free opportunity to help a colleague while also making sure the E.V.O.L.V.E.

team didn't have to work through the holidays unpaid.

the investment the following month, and therefore my immediate payback, seemed like a guarantee.

Fortunately, I took all legal precautions with the loan and put in place the necessary paperwork to protect myself.

Though repayment was supposed to be quick due to an incoming investment, it unfortunately fell through, and my initial loan repayment due date of January first, twenty twenty three passed by.

I'm not saying risk free is crazy, though.

Yeah, but understand, this is not an investment.

Jake didn't give the money as an investment into Evolve PCs.

He gave it as purely a loan to be paid back, of which he's got the documentation for.

That's why this is a big deal.

And this involves a lot of people, by the way.

A lot of people gave money to Evolve.

Evolve then pivoted to acquisition, and that's where things start getting screwy.

In early of the year, I'm informed that Evolve is being acquired by Gamers First, the esports organization founded by former NFL player Kenny Vaccaro, and that G One will be assuming the repayment of my loan.

At this point, G One was an up and coming organization, and after several discussions with Kenny, I felt very confident.

During this process, I was reassured multiple times by Kenny Vaccaro that my debt would be taken care of, and in June of the same year, we put in place the legal paperwork to reflect that.

Someone just commented, a loan is always an investment.

Sleepy, in this situation, it's different.

So for instance, I was approached by Evolve PC and was asked to invest in it.

And depending on how much I was to give, would give me equity in Evolve PC.

You see where I'm coming from?

Jake did not take that deal, or at least not to my knowledge.

His was purely, hey, you're in trouble right now, Triple.

Here's some money to help you in a jam.

Give me back in this timeframe.

You see what I'm saying?

There was no equity built in, again, at least to my knowledge.

I was supposed to be repaid in full plus interest by January, first, twenty, twenty four triple rec remained the guarantor.

The guarantor guarantor guarantor triple rec remained the guarantor on the loan, which meant if G one didn't come through by that date, the repayment responsibility would also be on him.

Several months later, a bunch of non payment allegations against G one started to become public.

And I became skeptical, skeptical that I'd be getting my money back.

In December, I reached out to Kenny directly to get some reassurance that I'd be paid in January, and I was less than reassured.

Following the repayment's due date, and after multiple attempts by my team and I to keep lines of communication open regarding that payment, I was ghosted by Gamers First and Kenny.

Since we last spoke, my team has found some interesting information about Kenny and Gamers First which provides important context for my dealings with them.

Apparently, we are not the only ones suing Kenny and Gamers First, as the landlord of the widely reported G One facility is also suing them in Texas for unpaid rent.

That lawsuit even alleges that Kenny failed to pay the rent on the facility two weeks before G One acquired Evolve and the debt owed to me, which, if true, shows that Kenny would have had to have been aware of financial problems prior to the acquisition, and cast doubt on his potential ability to follow through with the repayment.

The reality is,

Gamers First has failed to repay me the loan within our agreed timeframe.

And based on Kenny's actions and knowledge during this process, we believe that Kenny's personal liability is justified too.

This industry has always had non payment issues, but the only way this will change is if people are held accountable for their actions.

It's unfortunate that it's come to this, but I'm left with no other choice than to pursue this matter in court.

Ah, man.

So in the year of DCX, TripleRed was there and essentially it was rumored that Evolve was having a tough time.

And TripleRed reached out to a number of different content creators, considering that most of us know Triple from D.One.

You know, he was a very known Destiny streamer.

And, you know, I love that this was something he was pursuing.

Evolve PCs was someone who I was previously partnered with at least a few years ago.

And this is something outside of just like, hey, Triple is a streamer.

This is something, this was his dream that he wanted to do, was have this PC company.

But essentially, there was an issue with the partnership.

Things fell through, yada yada, money problems, and he needed money.

So he reached out to a bunch of different content creators.

Now, Jake and others were super kind enough to give a lending hand to this and essentially to keep Evolve PCs and Triple from going under.

Personally, I didn't have the funds necessary for Triple at the time, but I could have easily been someone who also contributed to this.

Now, I will say this.

At the time, I had asked Triple for his financials.

I wanted to see his balance sheet and essentially just his income statement for the past three years.

And I don't know, I never got that paperwork.

And so I felt uneasy as well.

If you're if you're asking for whether it is a loan or an investment, I need to know if you make good on it, you know, based on your what you have currently.

And if you're in a hole, I don't know how much you're in a hole, but what you're telling me is what you're telling me.

So I wanted to see some actual documentation.

Never got it.

So never went through on that.

But anyways, twenty, twenty two, I guess, G One, who was who had a big presence there at D.C.

What do I say?

Twenty, twenty two.

Yeah.

G One had a presence there at GCX.

Dude, I liked what G One was doing.

They looked like a cool organization.

They came in, they had swagger, you know?

A lot of the content creators we knew at the time were also in G One.

Hell, one of my editors used to work full time for G One.

But this to me is just a classic situation of everything went broke, is what I'm looking at.

You know, Vault PCs was already having money woes.

Then they get in with G.One.

G.One turns out is having major money woes because we saw last year G.One having issues with making payments for just the people that work for them.

And then things just kept rolling over.

I don't know if you remember, Les, there was a thing last year I read, and it was like people saying they haven't gotten paid for six to eight months.

That's crazy.

Six to eight months.

I don't know where, I mean, who knows?

You know, some people are saying it was a Ponzi scheme.

Maybe it was, you know.

Personally, I fell for Triple when he reached out because, you know, it didn't seem, you know, Triple wasn't the type to come around and like hold his hand out.

He, Evolve PCs had a good partnership program at the time, but something happened.

And I don't know if it's Evolve PCs continue to dip and just lose revenue.

or if G One sunk everything and then took down Evolve with them.

And I guess at the end of the day, it doesn't really matter because people like Jake and many other content creators are out of a lot of money.

All right.

So you may be saying Jake should just completely hand on this legally and say nothing about it.

OK, what if Evolve PCs is out there right now giving the same pitch they gave just a few years ago, the same pitch that I almost accepted and many other creators did accept.

That's why stuff like this being brought to the public needs to be brought to the public.

You don't want other people falling into the same exact trap.

This also, you know, rolls into the financial woes of G One.

People that were working literally six, eight months with no pay.

I think the writing's on the wall.

Move on, unfortunately.

I hate it.

But instead of sitting around waiting for G One to pay you, might be best to move on from that.

And again, I can't.

There was a lot of creators.

A lot of creators.

From gigs, I am unfortunately also owed twenty five thousand by an ex NFL player that I've received no communication on.

I just want my money, man.

But again, there are a lot of creators that gave money to this.

I'm surprised y'all stay quiet for this long.

Well, I didn't know.

I didn't I didn't know because I never gave money.

I never gave money.

But like, look here, Wall E even said, for those wondering, Jake is only one person of whom they've done this to.

You have no idea how many people helped them out and haven't gotten their money back, myself included.

F**k a dickhead's last time I helped a friend in need.

That's what also ruins this too.

It's like, look, man, we're at GCX.

We see triple red going around and talking to people just like in previous Guardian cons and DCX meetups.

You know what I mean?

And instead of, Hey man, how's it going?

Everything going good with you?

Yada yada.

It's, I had a partnership fallout.

I'm in some financial woes you feel bad for.

Unfortunately, it seems like a lot of people got that story and they all pitched in on this and it doesn't look like they're going to be getting their money back anytime soon.

But the other side of things is, you know, who, who is more at fault here?

I never got to see the financials of Evolved, so I don't really know myself how in the hole Triple actually was.

But I don't know if he drugged down G One, or if Evolved drugged down G One, or G One drugged down Evolved, or if they just both just drug each other down.

Doesn't matter who it is, family or friends, you get a lawyer and write up a contract.

Magnum, that's exactly what happened.

That's what Jake's saying here, guys.

He sent over the paperwork.

He signed it.

It was supposed to be a loan that would be repaid back within a certain amount of time.

It's all illegal.

You see where I'm coming from?

Now, other people, other people didn't do that.

Other contracts are meaningless if they can't pay.

Dude, that is the unfortunate part.

That is true.

I remember years ago, I've probably told you guys this before, we were doing, we were building a pellet mill.

And the pellet mill, the big job, I don't know, I think it was like maybe close to three hundred and twenty five million, somewhere around that mark.

But half the job got built, got paid, everybody got paid.

The second half was getting built, and there were productions going for the palace.

And at the time, no one was getting paid for the second half of the job.

All the contractors, concrete, steel guys, manufacturers coming in, the equipment that was coming in, they were all being told, or we were all being told, we were going to get paid.

And because they paid on the first half of the job, we were like, OK, maybe they're going to make good on the second half.

And they said essentially they needed to sell their pellets that they had made with the first half of the plant that was already in production.

And when they sold those pellets, then they would be able to make payment.

Well, the pellets kept going and they kept getting denied.

So they would actually take the pellets from here in the States and then send them over to Europe.

And something about the pellets, they weren't passing quality control for whatever reason.

And they did that over and over until that company went bankrupt.

And when that company was deemed insolvent, that was it.

And the second half of the job was almost finished, almost completely finished, and no one got paid.

No, I mean everybody had liens out their ass on this shit, but nobody got paid.

You essentially just built half the plant for free.

One point I'm trying to make is hopefully Jake gets his money back and these other people get their money back.

But I've seen time and time again where people have not gotten their money.

When you think about it, if G One wanted to buy Evolve, they must have been making money.

I don't know, man.

We've been a streamer slash content creator four times since the year of the mouse.

And, you know, I can look at metrics and I can tell like what you can and can't do financially.

Now, G One rolled in hot.

I mean, they had it all.

They had the good shit, the good gear, the good places they stayed at, the hotels, the planes, everything.

It looked great.

But man, that stuff is expensive.

I get it.

You don't want to you don't want to send your pro team to go stay in a motel six.

But if I had a pro team,

The best I could do is Holiday Inn, get in the kingdom.

I know that's part of the sale, right?

Is let's try to be the most prestigious looking group of gamers running around.

But we damn sure wouldn't be flying private.

And I think G One just ran out of money.

Some people were saying it's a Pondi scheme.

I just think they ran out of money.

They ran out of money.

I think Evolve ran out of money and they were both together and everything just went to sh**.

But, you know, get ahold of them legally and let's see if, you know, hopefully Jake gets his money back.

Hopefully other people get their money back.

This is a rough situation.

I hate it for Jake, man.

I hate it for a lot of people.

And the reason why we're talking about it today is I almost gave money to Triple.

With that being said, though, guys, at any point in the future, if a friend ever reaches out to you and asks to borrow some money, whether as an investment or a loan, I would highly advise, even if they're your closest friend, man.

And look, Jake and these other creators in the Destiny community are really nice people.

And I fell for Triple.

I remember at the time, I was like, Triple, if I had it, because I was finishing up the house, I was like, Triple, if I had it, I would help you, man.

But I need it.

I've got some obligations of my own.

I can't help you.

But there was that one thing in the back of my head that said, hey, send me your financial statements for the past three years.

Let me just take a look at them and I'll let you know.

And I never got anything back from them.

And so I didn't think much about it at the time.

I just said, OK, but maybe that's why.

Slap that like button like your mama told you, right?
